Belle Mode Intimates (“Belle Mode,” “we,” “us,” or “our”) is a DBA of PDM Enterprises, LLC, a Virginia limited liability company, located at 10427 North Street, Suite 103, Fairfax, VA 22030. This Privacy Policy explains how we collect, use, share, and protect your personal information when you visit www.bellemodeintimates.com (the “Site”), shop with us in our boutique or online, book an appointment, join the First Bras Club, subscribe to our messages, or otherwise interact with us (together, the “Services”).

By using the Services, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Services.

1. Information We Collect

Information you give us. When you create an account, place an order, book a fitting or styling appointment, request a special order, join the First Bras Club, sign up for our emails or texts, enter an event or fundraiser, or contact us, we may collect your name, email address, mailing and billing address, phone number, birthday (optional), payment information, order history, appointment details, and any notes you choose to share with us about your fit preferences or needs.

Fitting information. To serve you well, our fitters may record your bra size, fit notes, and preferred brands and styles. If you book a mastectomy or post-surgical fitting, we record only what is needed to help you find products that fit and feel right. We do not request medical records, and we do not bill insurance. You may ask us to limit or delete fitting notes at any time.

Information collected automatically. When you visit the Site, we and our service providers may collect device and usage information such as your IP address, browser type, pages viewed, referring website, and the date and time of your visit, using cookies, pixels, and similar technologies. See Section 6 for more on cookies.

Information from others. We may receive information from our service providers and partners, such as our e-commerce platform (Shopify), our customer relationship and messaging platform, payment processors, email and text message providers, shipping carriers, social media platforms, and analytics providers.

2. How We Use Your Information

We use personal information to:

• Process and fulfill orders, special orders, returns, and exchanges, and provide receipts and order updates.
• Schedule, confirm, remind you about, and follow up on fittings, styling appointments, and events.
• Operate the First Bras Club and any other membership or loyalty program you join, including sending welcome information, fit education, and member offers.
• Provide fitting services, remember your size and preferences, and recommend products.
• Send you marketing communications by email or text message when you have opted in, including sales, promotions, events, and news about the boutique.
• Respond to your questions and requests and provide customer support.
• Improve the Site, our products, and our services, and understand how customers use the Services.
• Detect and prevent fraud, protect the security of the Services, and comply with legal obligations.

3. Text Message (SMS) Communications

Belle Mode Intimates offers text messaging so you can receive appointment confirmations and reminders, special order updates, and, if you choose, promotions and event announcements.

Consent. You give us consent to text you by checking an SMS consent box on one of our online forms, by scanning our in-store QR code and completing the sign-up form, by texting a keyword to our business number, or by otherwise providing your mobile number and expressly agreeing to receive text messages. Consent boxes are never pre-checked. Appointment texts and marketing texts have separate consent boxes, and you may choose either, both, or neither. Consent to receive text messages is not a condition of any purchase or service.

What you will receive. Depending on what you opt in to, messages may include appointment confirmations and reminders, order and special order status updates, and promotional messages about sales, events, and new arrivals. Message frequency varies. Marketing messages are sent up to 4 times per month. Message and data rates may apply.

Opting out. You can stop receiving text messages at any time by replying STOP to any message from us. After you send STOP, we will send one final message confirming that you have been unsubscribed. For help, reply HELP or contact us at 703-543-4737 or support@bellemodeintimates.com.

No sharing of mobile information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the categories of sharing described in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Carriers. Wireless carriers are not liable for delayed or undelivered messages.

4. Email Communications

If you subscribe to our emails or make a purchase, we may send you transactional emails (order confirmations, appointment details, membership information) and, with your consent, marketing emails. You can unsubscribe from marketing emails at any time using the link at the bottom of any marketing email. You will continue to receive transactional emails related to your orders and appointments.

5. How We Share Information

We do not sell your personal information. We share it only as described below:

• Service providers. With companies that help us operate the Services, such as Shopify (our e-commerce and point of sale platform), our customer relationship, appointment, and messaging platform, payment processors, shipping and fulfillment providers, email delivery providers, website hosting, and analytics providers. These providers may use your information only to perform services for us.
• Legal and safety. When required by law, subpoena, or legal process, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others, or to investigate fraud.
• Business transfers. In connection with a merger, sale, or transfer of all or part of our business, your information may be transferred to the successor.
• With your direction. When you ask us to share information, for example with a partner business whose offer you have requested through the First Bras Club.

All of the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

6. Cookies and Tracking Technologies

The Site uses cookies and similar technologies to keep your cart, remember your preferences, understand Site traffic, and measure the effectiveness of our marketing. Our e-commerce platform and advertising partners (which may include Google and Meta) may set cookies or pixels for analytics and advertising. You can control cookies through your browser settings, and you can opt out of interest-based advertising through the Digital Advertising Alliance at optout.aboutads.info and the Network Advertising Initiative at optout.networkadvertising.org. Disabling cookies may affect some features of the Site.

7. Your Choices and Rights

• Marketing. Opt out of marketing texts by replying STOP and of marketing emails using the unsubscribe link.
• Access, correction, and deletion. You may ask us to access, correct, or delete the personal information we hold about you, including fitting notes, by contacting us using the details in Section 12. We will respond within a reasonable time and as required by applicable law. We may keep certain information as required for legal, accounting, or security purposes.
• Virginia residents. Under the Virginia Consumer Data Protection Act, you may have the right to confirm whether we process your personal data, to access, correct, or delete it, to obtain a copy, and to opt out of targeted advertising, the sale of personal data, or profiling. We do not sell personal data. To exercise these rights, contact us as described in Section 12. If we deny your request, you may appeal by replying to our response with the word “Appeal.”
• Other states. If you live in a state with a comprehensive privacy law, you may have similar rights. Contact us to exercise them.

8. Data Retention

We keep personal information for as long as needed to provide the Services, maintain your account and membership, meet legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. Fitting notes are kept so we can serve you on return visits; you may ask us to delete them at any time.

9. Security

We use reasonable administrative, technical, and physical safeguards to protect your information. Payments on the Site are processed by our payment providers and we do not store full payment card numbers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Children

The Site and our online Services are intended for adults. We do not knowingly collect personal information online from children under 13. First Bras Club sign-ups for a minor must be completed by a parent or legal guardian, who provides their own contact information and consent. In-store fittings for minors take place with a parent or guardian present. If you believe a child has provided us information online without consent, contact us and we will delete it.

11. Changes to This Policy

We may update this Privacy Policy from time to time. The updated version will be posted on this page with a new “Last Updated” date. Material changes will be communicated by email or a notice on the Site where appropriate.
